EFFECTIVE SEPTEMBER 22, 2026
These Terms of Service (the “Terms”) constitute a binding agreement between you and the operator of getitgames.app (the “Service”) governing your access to and use of the Service. In these Terms, “we,” “us,” and “our” mean the operator of the Service.
By accessing or using the Service you agree to be bound by these Terms and by the Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Service.
The Service is not directed to children under 13, and you may not create an account if you are under 13. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.
The Service provides browser-based games at no charge. It is offered on a non-commercial basis. There are no fees, subscriptions, in-application purchases, or advertising. Authentication is optional and its sole function is the synchronisation of saved-game data across devices.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
You are responsible for all activity occurring under your account and for maintaining the security of the Google account used to authenticate. You must not impersonate any person or entity, or select a display name that is unlawful, that infringes the rights of another, or that is obscene, harassing, or hateful. You may close your account at any time by written request to the address in section 16.
You must not, and must not permit any third party to:
Scores are transmitted by your browser and are not independently verified. Leaderboard standings are therefore provided for entertainment only and no representation is made as to their accuracy. Submitting fabricated or automated scores is a breach of section 6 and grounds for termination under section 12. We may reset, amend, or discontinue any leaderboard at our discretion.
The Service, including its games, source code, artwork, text, audio, and design, is owned by us and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership interest to you. Certain components of the Service are open-source software made available under their respective licences, which govern those components and prevail over these Terms to the extent of any conflict.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, error-free, or that saved-game data will be preserved.
Some jurisdictions do not permit the exclusion of implied warranties, in which case the foregoing exclusion applies to the fullest extent permitted.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business, arising out of or in connection with these Terms or the Service, whether in contract, tort, or otherwise, and whether or not we were advised of the possibility of such damages. Our aggregate liability arising out of or in connection with these Terms or the Service shall not exceed one hundred United States dollars (USD 100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
You agree to indemnify, defend, and hold harmless the operator of the Service from and against any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, for breach of these Terms or where necessary to protect the Service or its users. Sections 8 through 11 and 13 through 15 survive termination.
We may modify, suspend, or discontinue the Service or any part of it at any time. We may amend these Terms, and the effective date at the head of this page will be updated accordingly. Continued use of the Service following the effective date of an amendment constitutes acceptance of the amended Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in San Francisco County, California shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives a consumer of the protection of the mandatory law of their place of residence.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in respect of the Service and supersede any prior agreement on that subject matter. If any provision is held unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a change of control. There are no third-party beneficiaries to these Terms.
Notices and enquiries under these Terms, including requests to close an account, may be sent to ryan.a.husk@gmail.com.
